Aryan Khan denied bail again, moves high court

ARYAN Khan, the son of Indian actor Shah Rukh Khan, failed to get bail yet again as a special court in Mumbai on Wednesday (20) refused it to him and two others in connection with the seizure of banned drugs on board a luxury vessel off the coast of Mumbai earlier this month. He moved the Bombay High Court later in the day challenging the lower court’s order.

Special judge VV Patil, who is designated to hear cases related to the NDPS (Narcotics Drugs and Psychotropic Substances) Act, rejected the bail pleas of Aryan, 23, Arbaaz Merchant and Munmun Dhamecha. The trio were arrested by the Narcotics Control Bureau (NCB) on October 3 for alleged conspiracy, possession, consumption, purchase and trafficking of drugs.

They are currently in judicial custody. Aryan and Merchant are lodged at the city’s Arthur Road prison, Dhamecha is lodged at the Byculla women’s prison.

Aryan and the other accused have been booked for offences under sections 8(c), 20(b), 27, 28, 29 and 35 of the NDPS Act.

Aryan had in his bail plea said the NCB’s contention that he was involved in conspiracy and illicit drug trafficking was absurd and added that there was no recovery of drugs made from him.

The NCB opposed the bail plea saying Aryan had been consuming drugs for a few years now and had links with some persons who appear to be a part of an international drug network for drug procurement.

The agency was relying on WhatsApp chats of Aryan, which they claim point towards procurement of bulk quantities of drugs.

The anti-drug agency also argued that while there was no recovery from Aryan, the recovery of six grams of charas from his friend Merchant points to conscious possession by the starkid.

Aryan moved the Bombay High Court later in the day seeking bail. His advocates filed an appeal in the high court immediately after the lower court rejected his bail plea. The appeal is likely to be mentioned by Aryan’s lawyers on Thursday (21) before a single bench of Justice NW Sambre.
