Nearly one year after the death of Malcolm-Jamal Warner, his widow, Tenisha Warner, has filed a lawsuit seeking $1.2 million from the actor's family trust, alleging that several financial commitments outlined in their prenuptial agreement were never fulfilled.
According to court documents filed in DeKalb County Superior Court and obtained by multiple media outlets, including the Atlanta Journal-Constitution and CBS News, the lawsuit names Pamela Warner, the trustee of the late actor's trust.
Tenisha claims that Warner agreed to provide several financial benefits under a May 2022 prenuptial agreement, but those obligations remained unmet before his death in July 2025.
One of the lawsuit's central claims involves a $1 million life insurance policy. According to the filing, Warner had agreed to maintain the policy with Tenisha listed as the sole beneficiary. However, she alleges that the actor never purchased the insurance.
The lawsuit also claims Warner failed to compensate Tenisha for her work as his "chief of staff." In addition, she alleges he did not make annual payments promised in the prenuptial agreement, failed to contribute to her tax-free retirement account, and never established a college fund for their daughter.
"Plaintiff performed all obligations required of her under the agreement, including entering into and remaining in the marriage until the decedent's death," the lawsuit states. "The decedent died without having satisfied his obligations under the agreement, and no person or entity has paid or provided the sums due to plaintiff under the agreement."
According to reports, Tenisha argues that Warner's estate does not contain enough assets to cover what she says is owed under the agreement. As a result, she is seeking payment from the Warner Family Trust and has asked the court to prevent trustee Pamela Warner from distributing trust assets until the dispute is resolved.
In a statement shared with USA Today and CBS News, Tenisha said the actor intended to update his estate planning before his death.
"Malcolm had every intention to provide for our nine-year-old daughter and me," the statement reads. "He was close to finalizing a new estate plan to replace the stale plan created in 1996 when he was 26 years old, 20 years before we met and well before we gave birth to our beautiful daughter. Sadly, he was unable to do so before we lost him."
Malcolm-Jamal Warner, best known for playing Theo Huxtable on The Cosby Show, died on July 20, 2025, at age 54 after accidentally drowning while vacationing in Costa Rica with Tenisha and their daughter.
The lawsuit could determine whether the actor's family trust is responsible for honoring the financial commitments Tenisha says were promised before his death.
