Highlights:

  • Arfat Sheikh was detained by ICE at Dulles Airport.
  • His representatives say he has active work and residency authorization.
  • Sheikh has a pending asylum application, according to his campaign.
  • A federal habeas petition was filed after his detention.
  • His supporters are raising $50,000 for his legal expenses.

  • Kashmiri filmmaker Arfat Sheikh was detained by US Immigration and Customs Enforcement after arriving at Washington Dulles International Airport on September 24, raising questions about his immigration status, the circumstances of his arrest and what happens next.

Sheikh, 42, was reportedly traveling with author and filmmaker Tara Dorabji to attend an "Art as Resistance" panel at Busboys and Poets in Washington when he was detained.

The circumstances surrounding the arrest remain unclear, as neither ICE nor the Department of Homeland Security has publicly explained why Sheikh was taken into custody.

    What happened at Dulles?

According to Sheikh's campaign, multiple ICE agents surrounded and arrested him without a warrant as he stepped off the plane at Dulles.

The campaign says Sheikh presented his immigration paperwork to the agents but was nevertheless taken into custody.

Dorabji, who was traveling with Sheikh, provided a firsthand account of the incident. She said Sheikh called out to her that it was ICE and that agents took him from the jetway onto the tarmac.

The exact circumstances of the arrest have not been independently established.

ICE and the Department of Homeland Security have not publicly commented on Sheikh's detention or provided a reason for his arrest.

    What is his immigration status?

Sheikh's representatives say he has active work and residency authorization while an immigration application remains pending.

According to his campaign, Sheikh came to the United States in 2019 on a student visa to study film at Georgia State University. He applied for asylum in 2020.

The campaign has not disclosed the precise type of application pending in his case, and immigration authorities have not publicly confirmed the details.

    Sheikh lives in Alexandria, Virginia.

    Where is he now?

Sheikh is being held at the Caroline Detention Facility in Bowling Green, Virginia.

He was scheduled to appear before an immigration judge on Tuesday, October 6, for a procedural hearing and bond assessment. However, no confirmed public update was available on the outcome of that hearing at the time of reporting.

The campaign and his supporters have also not publicly confirmed whether bond was granted.

At a bond hearing, an immigration judge generally considers whether a detained person poses a flight risk or a danger to the community before deciding whether release is appropriate.

    A separate federal court case

There is another legal development that could become important.

According to news reports citing a federal court docket, Sheikh filed a habeas corpus petition on September 24, the same day he was detained.

A habeas petition challenges the legality of a person's detention in federal court. This case therefore operates separately from the immigration proceedings.

Why is Sheikh's case drawing attention?

Sheikh is the director of "Saffron Kingdom," a 2024 independent drama centered on families living through decades of conflict in Kashmir.

The film received honors including Best Feature Film at the Anatolian International Film Awards, while Sheikh was the inaugural recipient of the Emerging Filmmaker Activist Award at the 2025 Teaneck International Film Festival.

He has also openly criticized Bollywood's portrayal of Kashmir. In an interview with Dawn, he said Bollywood is used as "an instrument of oppression."

His personal connection to Kashmir is also deeply painful. His father, a renowned Kashmiri musician, was killed while traveling to Punjab.

    Supporters launch fundraiser

Friends and supporters have launched a fundraiser seeking $50,000 to cover Sheikh's legal expenses.

While he remains detained, "Saffron Kingdom" has also reportedly secured a major exclusive distribution deal.

The case comes amid heightened immigration enforcement in the United States, with ICE arrests reaching record levels this summer, about 50,000 in July and August alone.

For now, the biggest questions remain unanswered: Why was Sheikh detained, what will happen to his immigration case, and will he be released while those proceedings continue?

Sources: Sheikh's campaign and representatives; Tara Dorabji's account; news reports citing a federal court docket; Dawn; reporting from news outlets covering the detention. ICE and the Department of Homeland Security have not publicly provided a reason for Sheikh's detention.
