IN HIS first remarks after being released from Tihar Jail on Friday, Delhi Chief Minister Arvind Kejriwal said he will continue to fight against “anti-national” forces working to weaken the country and asserted that incarceration has only strengthened his resolve.
Hours after the Supreme Court granted him bail in the Delhi excise policy case, Kejriwal stepped out of jail to a resounding welcome by Aam Aadmi Party (AAP) leaders and supporters.
Addressing the party workers from the sunroof of a vehicle, Kejriwal, clad in a blue shirt, raised slogans such as “Inquilab Zindabad” and “Vande Mataram”.
“These anti-national forces that are trying to weaken the country, divide it…. I have always fought against them and will continue fighting against them,” he said and raised the slogan of “Bharat Mata Ki Jai”.
The chief minister stressed that the time spent in jail has only strengthened his resolve. “I have struggled a lot in my life and braved huge difficulties, but God has supported me in every step. He has supported me because I was truthful. They put me in jail. They thought that by putting me in jail, they will break my morale. My resolve has grown 100 times stronger and my strength has grown by 100 times.
“The thick walls of the jail and the bars cannot break me,” he said.
He thanked those who prayed for his release from jail.
Hundreds of AAP workers and senior party leaders, including Punjab chief minister Bhagwant Mann and former Delhi deputy chief minister Manish Sisodia, were waiting outside the prison to welcome Kejriwal.
Drenched in rain, Mann and Sisodia raised slogans from atop a truck hailing Kejriwal. Slogans like “Jail ke taale toot gaye, Kejriwal chhoot gaye” and “Bhrastachaar ka ek hi kaal, Kejriwal, Kejriwal” rent the air.
Kejriwal held a roadshow from the Chandgiram Akhara to his official residence and a large number of party leaders and workers joined him which had a large convoy of vehicles.
Earlier in the day, the Supreme Court granted bail to Kejriwal in the corruption case lodged by the CBI in connection with the excise policy ‘scam’, saying prolonged incarceration amounts to unjust deprivation of liberty.
A bench of Justices Surya Kant and Ujjal Bhuyan granted the relief to Kejriwal on furnishing a bail bond of ₹1 million (£9,065.55), and two sureties of like amount.
Kejriwal, who was arrested by the ED in the excise policy case on March 21, was granted interim bail on May 10 for campaigning in the Lok Sabha polls and has been in jail since June 2 when he surrendered.
The top court directed Kejriwal not to make any public comment on the merits of the case and added that terms and conditions as imposed in the ED case would also be applicable here.
The top court, while granting him bail in the ED case, had said that Kejriwal cannot visit his office or the Delhi Secretariat and not sign any official file unless absolutely necessary to obtain the Lieutenant Governor’s sanction.
It said completion of trial was unlikely to occur in the immediate future and rejected the apprehension of tampering by Kejriwal.
Justice Bhuyan, who wrote a separate judgement, concurred with Justice Kant on grant of bail.
CBI as caged parrot
However, Justice Bhuyan questioned the timing of Kejriwal’s arrest by the CBI and said the agency’s aim was to frustrate grant of bail to him in the ED case.
I fail to understand the CBI’s urgency to arrest Kejriwal on cusp of release in the ED case when it did not do so for 22 months, Justice Bhuyan said.
He said the CBI can’t justify arrest and continued detention citing evasive replies by Kejriwal, and added that non-cooperation cannot mean self-incrimination.
“The CBI must dispel notion of being a caged parrot, must show it is an uncaged parrot,” Justice Bhuyan said.
It would be travesty of justice to keep Kejriwal in custody when he has got bail in the ED case on the same grounds, he said.
Justice Bhuyan said he has serious reservations on the conditions imposed in the ED case on Kejriwal which bar him from entering the CM’s office and signing files.
“I am not commenting on conditions imposed on Kejriwal due to judicial discipline as it was in separate ED case,” he added.
The bench had on September 5 reserved its verdict on the pleas.
Two petitions
Kejriwal has filed two separate petitions challenging the denial of bail and against his arrest by the CBI in the corruption case filed by the central agency.
The AAP chief was arrested by the Central Bureau of Investigation (CBI) on June 26. He has challenged in the apex court the Delhi High Court’s August 5 order which upheld his arrest in the corruption case.
On July 12, the apex court had granted interim bail to Kejriwal in the money laundering case.
The top court had referred to a larger bench, preferably of five judges, for in-depth consideration of three questions on the aspect of “need and necessity of arrest” under the Prevention of Money Laundering Act (PMLA).
During the arguments on September 5 on Kejriwal’s plea in the corruption case, the chief minister had vehemently opposed in the apex court the CBI’s contentions that he should have approached the trial court first for bail in the corruption case.
Questioning the maintainability of Kejriwal’s pleas, Additional Solicitor General S V Raju, appearing for the CBI, had submitted that even in the money laundering case in which he had challenged his arrest by the ED, he was sent back by the apex court to the trial court.
Celebration in AAP camp
Celebrations began outside the AAP headquarters in New Delhi on Friday after the Supreme Court granted bail to Kejriwal in the corruption case linked to the excise policy ‘scam’.
The AAP leaders and workers distributed sweets and burst crackers outside the party headquarters here.
Sweets were also distributed outside the residence of AAP leader Manish Sisodia.
The AAP leaders and workers gathered outside the party office, and broke into celebrations soon after the apex court granted bail to Kejriwal.
Kejriwal’s release from the Tihar Jail will be a shot in the arm for the party as it prepares for the elections in Delhi and Haryana.
Former deputy chief minister Manish Sisodia, who was recently granted bail in the excise policy cases of the ED and CBI by the apex court, said on X, “Today truth won again in the fight against lies and conspiracies. I once again pay my tribute to the thinking and foresight of Baba Saheb Ambedkar ji, who 75 years ago had strengthened the common man against any future dictator.”
AAP Rajya Sabha MP Raghav Chadha thanked the apex court on the decision.
In a post on X, Delhi Minister Atishi said, “Satyamev Jayate. Truth can be troubled, not defeated.”
AAP Rajya Sabha MP Harbhajan Singh also welcomed Kejriwal’s release, saying “he will continue to dedicate himself to serve the people”.
“Glad that our beloved leader Shri @ArvindKejriwal Ji got bail in Supreme Court. This will definitely rejuvenate the party workers and give wings to @AamAadmiParty campaign in Haryana. He will continue to dedicate himself to serve the people,” Singh said in a post on X.
Kejriwal should resign: BJP
The Delhi BJP on Friday called for Kejriwal’s resignation, saying he cannot discharge the duties as chief minister as per the bail conditions for his release.
Delhi BJP president Virendra Sachdeva said in a statement that Kejriwal has got bail from the court but he has no right to remain on the post of the chief minister.
“He should step down as the chief minister if he can not work on the post,” Sachdeva said, adding that the SC has also clarified that his arrest by the CBI in the excise policy case was legal. (PTI)
